The booking
When booking your surf lesson or hire with Wave Riders Surf School Newquay, a contract is formed once the online booking process is complete and the payment is made. The person signing the booking form accepts full responsibility on behalf of all persons who form part of that booking, and for the full payment thereof. It is also their responsibility to ensure that all participants have read and understood these terms and conditions, and that they are aware of the details and requirements of the booking.

All participants must complete our Acknowledgement of risk form before they will be allowed to take part in any surf lessons.

A parent/guardian must sign on behalf of any participants under the age of 18yrs. Participants must be 8 years old or above to take part in an open-group surf lesson.

Wave Riders Surf School Newquay does not accept any liability for any loss caused by failure to complete the Acknowledgement of risk form .

Payments
Payments are made in full before the surf lesson or hire by online payment via our online booking system.

Changing the booking
We will try our very best to accommodate you if you request to change your surf lesson day/time, however this is subject to availability and/or tides, sea conditions/weather conditions. If we are unable to agree on a time then a voucher will be issued.

Cancellations
If you cancel a booking 7 days prior to the event the booking is non-refundable.
If you cancel a booking prior to 7 days before the event the booking is fully refundable.
No-shows will not be entitled to a refund.

Liability and other important information
The activity of surfing carries with it a degree of risk both to people and property, even when enjoyed under professional supervision. Surfing is a physically demanding activity that requires participants to have a reasonable level of fitness and swimming ability.
All participants suffering any physical or medical conditions, illnesses or allergies, including any prescribed medications, should make us aware of any such conditions or requirements at the time of booking. It is the responsibility of the participant with a medical condition to check with their doctor to find out if surfing is considered within their physical and or mental parameters.

No-one should participate in any surfing lesson if they are pregnant or suffering from a heart condition.
​
All participants must be able to swim at least 25 metres and should, under no circumstances, be under the influence of any alcohol or drugs at the time of the lesson.You must inform us at the time of booking if you are on any medications and you must not particapate if we have no been made aware of this.

Participants must agree to abide to all instructions and decisions made by Wave Riders Surf School Newquay and its instructors, to ensure the safety and comfort of all participants.

Participants will have the use of Wave Riders Surf School Newquay's equipment during their lessons and, although we take all reasonable measures to maintain their condition,surf lesson participants are responsible for immediately reporting any damage caused to the equipment, or that which becomes apparent whilst the equipment is in their possession.

Wave Riders Surf School Newquay does not seek to limit or exclude any liability for personal injury or loss of life which may occur because of it's own negligence or that of its employees, officers, or agents however, Wave Riders Surf School Newquay assumes no liability in respect of any personal injury, loss, damage, consequential loss or third-party claims which occur through no fault of its own, its employees, officers or agents. All other liability or conditions implied by law are excluded fully.

Surf conditions
In the rare event that Wave Riders Surf School Newquay considers sea conditions to be unsuitable for surf lessons, or in the event of the lifeguard service closing the beach (red flag), then an attempt will be made to reschedule the session to a more suitable time/day. If rescheduling the session is not an option then a credit voucher will be given.

Brochure and website accuracy
Whilst every effort is made to ensure the accuracy of Wave Riders Surf School Newquay website and advertising/marketing material, it is intended only as a guide to the services it provides. Anyone entering the sea should first check with the lifeguards and must not soley rely on the website accuracy.

Control of substances hazardous to health
Wave riders surf school sanitises any equipment that comes into contact with customers before reuse.
Hire terms and conditions

Surf Equipment Hire (Overview)
Hiring any equipment will require a form of photo ID. We will accept either: a driving licence or a passport. A photo of this will be kept during the hire period.

All equipment hired is at your own risk. Customers hiring equipment from Wave Riders Surf School Newquay must follow the rules of the beach and the RNLI Beach lifeguards.

Customers must ensure prior to hiring that they are not under the influence of alcohol or drugs or any medical condition that would make it dangerous to participate. We reserve the right to refuse hire to any customer if we consider any of the above conditions are likely not to be met or we consider surf or weather conditions to be unsafe.
If you have never surfed before we highly recommend attending a surf lesson at Wave Riders Surf School Newquay. We can book this through our website or by contacting us. This will cover all safety and basics that will help you stay safer in the sea.
We ask that you please look after the equipment we hire to you as if it were your own. We also ask that you do not leave any equipment unattended at any time.

By hiring equipment from Wave Riders Surf School Newquay, you are agreeing to these Terms & Conditions and acknowledge that you have understood and accepted these terms.

Full Hire Terms and Conditions
Security / Identification Hirers are required to present a legitimate form of photo ID. A valid driver's licence or passport is acceptable.
A photo of your ID will be held during the equipment rental period and returned upon equipment return, pending inspection. Please refer to the section below on late returns or equipment damage.
Even when used as intended, surfing and the use of rental equipment can be risky by nature. By renting the equipment, you acknowledge that you are exposed to certain risks, including physical dangers, erratic and occasionally dangerous surf and weather conditions, and other people's behaviour.
In signing this document, you acknowledge that accidents can and often do happen which may result in you being injured or worse. You have voluntarily read and understood this warning and accept and assume the inherent risks in using the hire equipment.
Use of Hired Equipment
As a hirer, you acknowledge that the use of the Hired Equipment (Surfboards, Bodyboards, Wetsuits, Paddleboards) is outside the Wave Riders Surf School Newquay's supervision. You understand and accept that any advice, recommendation, information, or services offered by Wave Riders Surf School Newquay in relation to the Hired Equipment and it's use are not contractual conditions or warranties.
In signing you agree that Wave Riders Surf School Newquay shall not be liable to you for loss or damage sustained by yourself as a result of any incorrect advice, recommendations, information, or services provided by ourselves regarding the Hired Equipment or the methods or conditions of use of the Hired Equipment, subject to the Exclusion of Implied Terms as detailed below.
Exclusion of Implied Terms
Where I am a consumer of recreational services, as defined by any relevant law, certain terms and rights usually implied into a contract for the supply of goods or services may be excluded.

You acknowledge that these implied terms as well as other terms and rights implied into consumer contracts by statute and any liability of Wave Riders Surf School Newquay flowing from them, are expressly excluded to the extent possible by law, by this agreement.
To the extent of any liability arising, the liability of Wave Riders Surf School Newquay will be limited to the resupply of the hiring services or payment of the cost of having the hiring services supplied again. The Wave Riders Surf School Newquay’s liability does not extend to consequential loss.
Late Return of Damage to Hired Equipment
Inability to return Hire Equipment may be the subject of a criminal complaint for theft against the civil liability of the parties' contract.
If you return the leased equipment after the rental period has elapsed, you agree to pay any additional charges for that time period.
By signing this, you agree to accept full responsibility and liability for any loss or damage to the Hired Equipment that occurs during your hire of the Hired Equipment (however caused).

Any damage/loss must be notified immediately to Wave Riders Surf School Newquay and the Customer will be held liable for the damage/loss. You also agree to compensate us for any loss or damage to the Hired Equipment, including replacement if necessary, and authorise Wave Riders Surf School Newquay to apply charges to the cost of the item.
This damage cost will be determined by Wave Riders Surf School Newquay.
If the customer's equipment is lost or damaged beyond repair, he or she will be invoiced at replacement cost.
Fitness to Participate
You affirm that you (and anybody else for whom you are responsible) are medically and physically fit to participate in the sport of surfing/bodyboarding/stand-up paddle boarding and utilise the Hired Equipment.
Hirers must be able to swim at least 25m for surfing and bodyboarding and 50m for stand-up paddle boarding.
You understand and accept that Wave Riders Surf School Newquay will rely upon this agreement as evidence of your fitness and ability to properly use the Hired Equipment.
Privacy
In signing this you understand that the information you have provided above is necessary for the objects of Wave Riders Surf School Newquay. You acknowledge and agree that the information will only be used for the objects of the Wave Riders Surf School Newquay and its general business. You understand that you will be able to access the information, through Wave Riders Surf School Newquay, upon reasonable notice.

The buiness shall hold your personal details on file and on computer in accordance with GDPR regulations 2018.
Permission is given for participant’s contact details to be entered into the Wave riders surf school database and held in accordance with the GDPR 2018. This information will not be forwarded to third parties.
